The ESIGN Act was signed into law on 30 June 2000 by President Clinton, taking effect immediately. It applies to transactions in or affecting interstate or foreign commerce.

The ESIGN Act applies federally across all 50 states. However, states that have adopted UETA may apply UETA rules instead of the ESIGN Act for intrastate transactions, provided the state law does not diminish the rights and obligations created by ESIGN.

The ESIGN Act excludes wills and testamentary trusts, adoptions, divorces, court orders, notices of utility disconnection, recall notices for products that risk endangering health or safety, and documents governed by the Uniform Commercial Code (Articles 3, 4, and 5).
